1 Acceptance of Terms

These Terms form a binding agreement between you and SafeRetireUSA. By accessing or using the Services, submitting your information, or requesting to be connected with a professional, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2 About the Services

SafeRetireUSA is a consumer education and referral platform. We provide general information about retirement planning and help connect individuals with independent, licensed insurance and financial professionals who may be able to assist them.

SafeRetireUSA is not an insurance company, insurance agency, registered investment adviser, broker-dealer, bank, or law or accounting firm. We do not sell insurance or investment products, and we do not provide insurance, investment, financial, tax, or legal advice. Any products or services you obtain are provided solely by independent, licensed third parties, subject to their own terms, underwriting, and approval.

3 No Professional Advice

All content on the Services is provided for general informational and educational purposes only and does not constitute insurance, investment, financial, tax, or legal advice, nor a recommendation, solicitation, or offer to buy or sell any product. The information may not apply to your individual circumstances.

4 Eligibility

You must be at least 18 years old and a resident of the United States to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current, and complete.

5 Consent to Be Contacted

By submitting your information through the Services and providing your consent, you expressly authorize SafeRetireUSA and the independent professionals and partners we connect you with to contact you at the telephone number(s) and email address you provide — including through automatic telephone dialing systems, artificial or prerecorded voice messages, and text (SMS/MMS) messages — regarding retirement, insurance, and financial products and services, even if your number is on a state or federal Do-Not-Call registry.

Consent is not a condition of purchasing any goods or services. Message and data rates may apply, and message frequency varies. You may opt out at any time as described in our Privacy Policy (reply STOP to texts, use the unsubscribe link in emails, or ask to be added to our internal Do-Not-Call list). Calls may be recorded or monitored for quality, training, and compliance.

6 Your Responsibilities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

7 Independent Professionals

Professionals to whom we refer you are independent third parties, not employees, agents, or partners of SafeRetireUSA, and we do not control them. We do not endorse, guarantee, or assume responsibility for any advice, products, services, recommendations, or conduct of any professional or partner. Any agreement you enter into with a professional is solely between you and that professional. We are not a party to, and are not responsible for, any such transaction. You are responsible for evaluating the suitability, licensing, and qualifications of any professional before doing business with them.

8 Intellectual Property

The Services and all content, features, and functionality — including text, graphics, logos, the SafeRetireUSA name and brand, designs, and software — are owned by SafeRetireUSA or its licensors and are protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Services without our prior written consent. We grant you a limited, revocable, non-exclusive license to access and use the Services for your personal, non-commercial use.

The Services may contain links to, or content from, third-party websites and services that we do not control. We provide these links for convenience only and are not responsible for the content, accuracy, or practices of any third party. The Services and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, SafeRetireUSA disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any information provided through the Services is accurate, complete, or current. Any reliance you place on such information is at your own risk.

11 Limitation of Liability

To the fullest extent permitted by law, in no event shall SafeRetireUSA, its officers, directors, employees, affiliates, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Services or your interactions with any professional or partner, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.

To the fullest extent permitted by law, SafeRetireUSA’s total aggregate liability for all claims relating to the Services shall not exceed one hundred U.S. dollars (US $100.00). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12 Indemnification

You agree to indemnify, defend, and hold harmless SafeRetireUSA and its officers, directors, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13 Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you agree that any dispute will be resolved exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction.

14 Changes to These Terms

We may modify these Terms at any time. When we do, we will update the “Effective Date” above. Changes are effective when posted. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15 General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent; we may assign them freely. These Terms, together with our Privacy Policy, constitute the entire agreement between you and SafeRetireUSA regarding the Services.
